In a matter which involved a patent infringement of a safety I.V. Cannulae between the two giants in the field M/s B. Brain, Germany and Medi Kit. The case involved the intricate mechanism of the safety I.V. Cannulae. Since, we were appearing for the Defendants accused of infringement, the I.V. Cannulae was to be dismantled and the locking device in the I.V. Cannulae was required to be shown to the Hon’ble Court. The two sides adopted different strategies. The German Company sought permission and demonstrated the locking device of the needle by holding a video presentation on a screen specially put in the Court room.
The Indian company chose the conventional method, with Mrs. Ekta and Mrs. Ekta got 6 trays from a Jeweller (which are velvet covered and jewellery is shown on the same) and on each tray a separate positioning of the Cannulae was placed so to show the Hon’ble Court the various stage of the locking device.
A victory against the German Giant was a feather in the cap crowning the efforts of the team.
